01. In the instant petition, notice was issued on 19.12.2011 and last date was fixed on 04.05.2012. 2012. The instant petition has come up before this Court after 13 years and during this intervening period, there was no effort being made on the part of the petitioner to get this petition listed, thus, an inference can be drawn that the petitioner is not interested in prosecution the instant petition.
02. Today also, when the instant petition was taken up, there is no representation on behalf of the petitioner. Even otherwise also, learned counsel for the respondents submits that with the afflux of time, the petition has been rendered infructuous and this is the precise reason that there is no representation on behalf of the petitioner today.
03. In the aforesaid backdrop, no fruitful purpose will be served by keeping this petition pending and the same is, accordingly, dismissed for non- prosecution.
