1. Learned State counsel raises an objection that writ petition on behalf of petitioner in its form is not maintainable as the notice which is subject matter of challenge is given to Badri Prasad Sahu in an individual capacity and not in the capacity of President or the notice is issued to Navjeevan Foundation Chhattisgarh, however, petition is filed by Navjeevan Foundation Chhattisgarh.

Learned counsel for petitioner submits that petitioner is President of Navjeevan Foundation Chhattisgarh, therefore, petition is filed impleading Navjeevan Foundation Chhattisgarh as petitioner.
3. I have heard learned counsel for parties.

Perusal of Annexure P-3 would show that notice is issued by Police Station Nawagarh, District – Janjgir-Champa under Section 94 of B.N.S.S. to the Badri Prasad Sahu in the individual capacity for organizing the prayer in his house, as to whether he had taken any prior permission from the authorities or not.
5. In the aforementioned facts of the case, this writ petition in in its form filed by Navjeevan Foundation Chhattisgarh is not maintainable, accordingly it is dismissed. Sd/- (Parth Prateem Sahu) Judge Balram
