Heard learned counsel for the parties and perused the record. 2. The order dated 08.04.2025 passed by Block Development Officer, Jamaniya, Ghazipur/respondent no.2 is under challenge in the present writ petition. By the aforesaid order petitioners were directed to deposit a sum of Rs.24456/- each total Rs.73370/- within a week in the MGNREGA account. The aforesaid order is reproduced hereinbelow :- "आई०जजी०आर०एस० सन्दरर ससं० 60000250066981 एवसं 60000250056991 शशिककायतकरकार शजी मननोज कक मकार रकाय पकत्र स्व० शवजजेन्द्र रकाय शनवकासजी गकाम -बजेटकाबर कलकासं कजेत्र पसंचकायत सजे बजेटकाबर मजे फहजीपकर पनोखरका सजे सरपसंच यकादव कजे दकार हनोतजे हहयजे ढढ.नजी शपच सड.क तक करकायजे गयजे चकबन्ध ककायर कजे बजीच सजे गकाम पसंचकायत दकारका रकामवचन शिमकार कजे घर सजे रशवन्द्र कजे खजेत हनोतजे हहयय कजे शिरजी रकाय एवसं लकालजजी कजे घर तक चकबन्ध ककायर चयन शकयका गयका जजसककी आई०डजी० ससं0-316001402/LD/958486255824400514 हहै। एवसं मस्टरनोल ससं0 8624 सजे 8626 शदनकासंक 03.01. 2024 दकारका मक0 73370.00 कका रकगतकान कजे सम्बन्ध मय हहै। उपयकरक्त प्ररकण कनो जजॉच शत्रसदस्यजी सशमशत गशठित कर करकायजी गयजी , सशमशत दकारका स्पष्ट रूप सजे अवगत करकायका गयका शक कजेत्र पसंचकायत दकारका करकायजे गयजे ककायर्यो कजे बजीच सजे हजी नकाम बदलकर गकाम पसंचकायत दकारका अवहैध ढगसं सजे मक 0 73370.00 कका रकगतकान करकायका गयका हहै, जजसकजे जलयजे आपलनोग दनोषजी हहै। अततः आपलनोगनो कनो शनदरशशित शकयका जकातका हहै शक एक सपकाह कजे अन्दर फजर्जी रकगतकान ककी गयजी धनरकाशशि मक0 73370.00 रू० ससंयकक्त रूप सजे बरकाबर मक0 24456.00 ककी दर सजे मक0 73370. 00 मनरजेगका स्टजेट एककाउन्ट मय जकामका कर अवगत करकानका सकशनशशचत करय।" 3. From perusal of the aforesaid order, which is quoted above, it is clear that the same was passed without any notice and opportunity to the petitioner. 4. In this view of the matter, the Court is of the opinion that the order passed is complete violation of principles of natural justice. 5. In the facts and circumstances of the case, the notice dated 08.04.2025 by which direction was given to the petitioner to deposit a particular amount should be treated as notice. The petitioners are directed to submit a reply to the aforesaid notice within three weeks from today. If it is so the respondent no.2 will take a decision on the basis of reply submitted by the petitioner within next six weeks. 6. For a period of three months or till the time fresh order is passed, no coercive action shall be taken against the petitioner. 7. Accordingly, present writ petition is disposed of.
