Order No.03/Dated- 11th April, 2025 Heard learned counsel for the parties.
2. This application has been filed for modification in order dated 10.05.2024 passed in A.B.A. No. 7376 of 2023 with a prayer to extend the period of surrender of the petitioner in the court below.
3. It is submitted by learned counsel for the petitioner that petitioner had moved before this Court in anticipatory bail application vide A.B.A. No. 7376 of 2023 and this Court vide
order dated 10.05.2024 had granted anticipatory bail to the petitioner and the petitioner was directed to surrender in the court below within four weeks from the date of the order, but the petitioner could not surrender in the court below within the aforesaid period.
4. It is further submitted by learned counsel for the petitioner that at the relevant time the petitioner was bed ridden due to ill health and was suffering from acute joint problems and he is also acute diabetic, suffering from several old aged diseases, even not in a position to attend the nature’s call on his own, and when he recovered a little bit from the above mentioned problems, but thereafter, the time of surrender given by this Hon’ble Court has been elapsed. Therefore, it is prayed that for

the ends of justice, the period for surrender of the petitioner in the court below may be extended.
5. In view of the above submissions, the order dated 10.05.2024 passed in A.B.A. No. 7376 of 2023 is modified to the extent that the petitioner shall surrender before the court below within two weeks from the date of receipt of copy of this order.
6. Rest part of the order dated 10.05.2024 shall remain intact.
7. Cr.M.P. No. 454 of 2025 stands allowed.
