During course of argument, informant's counsel raised objection that instant 528 BNSS application filed against the order dated 15.07.2024, U/s 164(1) and 165(1) BNSS. The order passed under challenged therein is an interlocutory order. He further submits that further development occurred, thereafter, Nagar Magistrate, Gorakhpur, vide its order dated 05.05.2025, decided the proceedings pending between the parties finally and order dated 05.05.2025 has been challenged by filing Criminal Revision bearing No.4265 of 2025, as such, the present application has become infructuous. In view of the aforesaid, the present application U/s 528 BNSS is hereby dismissed as infructuous.
