Petitioner has filed this writ petition seeking following reliefs: “(i) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the representation and to grant compensation amount of Rs. 2,00,000/- as per notification dated 25.02.2022, with interest from date of incident, within stipulated time, in the interest of justice. (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted, in the interest of justice.” 2. Learned counsel for the petitioner submits that brother of petitioner while travelling on road was hit by unknown vehicle due to which he suffered grievous injury and during course of treatment he succumbed to motor accidental injuries. Petitioner thereafter submitted an application before the Tahsildar for grant of compensation under the policy formulated by the State on ‘Hit and Run’. However, till date Tahsildar has not taken any step nor awarded compensation. 3. Learned counsel for the State submits that according to directives issued by the Ministry of Road Transport and Highways, Govt. of India, State of Chhattisgarh has constituted a Committee to consider claim of ‘Hit and Run’ cases and the Collector is President of Committee constituted of seven Members. Petitioner has not submitted any application before the Collector or the Committee. 4. In the aforementioned facts of case, considering the nature of grievance as raised in this petition, further that petitioner has not submitted any application before the Committee headed by Collector to consider claim of ‘Hit and Run’ cases, this petition at this stage is 3 / 3 disposed off permitting the petitioner to submit an application/representation before the Collector-cum-President of Hit and Run Committee at District Level and if such a representation is submitted, Collector/Committee shall consider and take decision on the claim of petitioner in accordance with law, expeditiously, within a further period of 3 months from the date of receipt of application.
