CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 9th December 2025 P C : The present Writ Appeal has been preferred against the judgment and order dated 01.05.2025 in Writ Petition No.12791 of 2024 by the appellant, who is not a party respondent in the writ petition. However, the present writ appeal was permitted to be filed after leave was granted to the appellant. 2. The case of the petitioner before the learned single Judge was that he had been allotted land measuring Ac.0-90 cents falling in Sy.No.100 situated at Chevireddypalli, Venkatagiri Mandal, Tirupati District, which later on was stated to be part of the reserve forest. In that eventuality, the petitioner was sought to be dispossessed from the land in question which gave cause of 2 action to the petitioner to approach the learned single Judge by way of the aforementioned writ petition. 3. During the course of arguments, it was suggested by the learned counsel for the Revenue that an alternate site would be allotted to the petitioner in place of the earlier allotment. On that understanding, the writ petition was disposed of at the very initial stage. The alternate site that was to be allotted in favour of the petitioner, who is respondent No.1 in the present writ appeal, is claimed to be in possession of the appellant, who claims valid title over the said parcel of land. The appellant is also stated to have preferred Writ Petition No.32483 of 2025 in which the petitioner claims that he be not dispossessed otherwise in due course of law. 4. Since none of the rights of the parties were dealt with by the learned single Judge in the writ petition, which came to be disposed of at the very inception, and since the appellant also claims right and title over the parcel of land measuring Ac.0-98 cents falling under Sy.Nos.96/16 and 96/17 of Chevireddypalli, Venkatagiri Mandal, Tirupati District, we deem it appropriate to remand the matter back to the learned single Judge for consideration afresh. 5. Registry is directed to list W.P.No.12791 of 2024 along with W.P.No.32483 of 2025 for consideration on 19.12.2025 before the learned single Judge having roster. 6.
