Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act. 3 . Prosecution case is that 31.335 liters of illicit liquor was recovered from Mango Orchard and two motorcycles were also recovered from the spot. 4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of petitioner was disclosed by local choukidar. Recovery is from open place . Petitioner is not the owner of mango orchard. No incriminating material has been recovered from the conscious possession of the petitioner. Patna High Court CR. MISC.
