Order on Board 16.12.2025
1. The petitioner has filed this writ petition under Article 226 of the Constitution of India assailing the order dated 18.07.2025 by which he has been transferred on promotion from District Treasury Officer Korba, District Korba (C.G.) to Assistant Accounts Officer, Janpad Panchayat Masturi, District Bilaspur (C.G.).
2.
Learned counsel for the petitioner would submit that the petitioner’s wife is suffering from illness and he does not intend to opt promotional post, as such, he has already preferred a MANISH YADAV Digitally signed by MANISH YADAV Date: 2025.12.19 18:47:45 +0530
2 representation on 15.10.2025, but the same has not been considered and he would pray for quashing of the transfer order.
3. On the other hand, learned State counsel opposing the submission would submit that the petitioner has nowhere mentioned since long he is posted in a particular place and even if he does not intend to join the promotional post, he can transferred as the transfer is incident of service and she would further submit that the personal difficultly can be no ground to interfere in the transfer.
4. I have heard learned counsel for the parties and perused the record with utmost circumspection.
5. Considering the fact that the petitioner has mentioned in the writ petition that he was appointed as Assistant Grade-III in the Treasury Department in the year 1994 at District Bilaspur (C.G.) and he was promoted in the year 2008 as Assistant Grade-II and thereafter, he was promoted on the post of Assistant Grade-I in District Korba only. Thus, he remained at Korba from 1994 till the promotion order dated 18.07.2025 issued by the respondents i.e. after lapse of 31 years of service.
6. The petitioner intends to remain posted forever at a particular place, which cannot be allowed in the garb of forgoing promotion avenues by the petitioner as the transfer is incident of service, therefore, I am of the view that no case for interference is made out.
7. Accordingly, the writ petition sans merit dismissed.
