PUBLIC PROSECUTOR The Court made the following: ORDER: The instant Criminal Petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), has been filed by the Petitioners / Accused Nos.3 and 4, seeking regular bail in connection with Crime No.509 of 2025 of Nunna Police Station, Vijayawada, registered for the offences under Sections 64(1), 49, 96, 137(2) and 127(2) read with 3(5) 2 of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’) and Sections 4 and 17 of Protection Of Children from Sexual Offences Act, 2012. Heard Ms.Kolusu Soundarya, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor. 3. Learned counsel for the Petitioner would submit that the Petitioners had not committed any offence and are falsely implicated in the present case. It is further submitted that they have been in jail since 21.12.2025. Learned counsel would submit that entire investigation is completed and charge sheet is also filed. Learned counsel for the Petitioners would further submit there are no criminal antecedents against the Petitioners. It is further submitted that the Petitioners are the only bread winners of their families and are ready to furnish sureties to the satisfaction of the Court. 4. Learned Assistant Public Prosecutor though opposed the petition. Having regard to the submissions made by the learned counsel for the Petitioners as well as the learned Assistant Public Prosecutor, and perusal of the material available on record, this Court finds that the Petitioners have been in judicial custody since 21.12.2025. The investigation in the present case is said to have completed and the charge sheet has already been filed. There are no criminal antecedents reported against the Petitioners. 2. 5. on 6. Considering the aforesaid facts and circumstances, this Court is of the opinion that further continued detention of the Petitioners is not warranted and they are entitled to be enlarged on bail, subject to certain conditions. 3 7. Accordingly, the Criminal Petition is allowed with the following conditions: (i) The Petitioners / Accused Nos.3 & 4 shall be released on bail on executing personal bond for Rs.20,000/- (Rupees twenty thousands only) each with two sureties for a like sum each to the satisfaction of the concerned Court, (ii) The Petitioners / Accused Nos.3 & 4 shall appear before the concerned Station House Officer once in a week i.e., on every Sunday between 10.00 a.m., till 5.00 p.m., until further orders. The Petitioners / Accused Nos.3 & 4 shall not directly or indirectly tamper with the prosecution witnesses or influence them in any manner, (iv) The Petitioners / Accused Nos.3 & 4 shall cooperate with the trial and appear before the Court on all dates of hearing without (iii) fail. The Petitioners / Accused Nos.3 & 4 shall not leave the jurisdiction of the Court without prior permission of the Court. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
