Judgment on Board Per Ramesh Sinha, Chief Justice 09/12/2025
1. The present petition has been filed by the petitioner praying for the following relief:-
“1. That, in view of the above the FIR, the Charge Sheet dated 21/08/2025 (Annexure P/1) as well as the criminal proceedings pending before the learned Judicial Magistrate 1st Class, Rajpur, District Balarmpur- Ramanujganj (C.G.) in Criminal Case No. 1841/2025 (Annexure P/2), may kindly be quashed to the extent of the petitioner.
2. That, a command/direction may also be issued to call for the entire records pertaining to the case of the petitioner for the kind perusal and proper adjudication of the matter.
3. That, any other relief which is deem fit and proper may also be awarded to the petitioner.”
2. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one as the order taking cognizance has not been challenged herein, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer, to which
learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer.

3. Learned State counsel has no objection.
4. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court for wasting precious time of the Court and producing the receipt of the same at the time of filing of fresh petition, if any. The said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.).
5. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same. - Sd/-
