The petitioner has made an application for transfer to Nagar Palika, Etawah or Nagar Palika, Auraiya. The only prayer made by Shri Devendra Kumar Shukla, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Learned Standing Counsel submits the matter requires factual determination as per applicable law by the competent authority in the first instance and claim of the petitioner needs to be ascertained. However, he fairly contends that the representation of the petitioner for transfer is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner regarding transfer as per law within a period of one month from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
