The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking regular bail in FIR No. 584/2020 registered at Police Station Mahendra Park, for the offences punishable under Sections 302, 307, 324, 147, 148, 149 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’). 3. Learned counsel for the Applicant submits that the trial is likely to take considerable time to conclude and that the Applicant has remained in judicial custody for more than five years. He, therefore, submits that the Applicant be granted bail. 4. Per contra, learned APP for the State submits that the allegations against the Applicant pertain to the offence punishable under Section 302 of the IPC. He further submits that the FSL report has been received and the DNA profile of the blood found on the clothes of all the accused persons This is a digitally signed order. Learned APP has handed over the FSL report in Court and submits that the allegations are grave and heinous. 5. This Court has considered the submissions advanced by the learned counsel for the parties. The allegations against the Applicant pertain to the offence punishable under Section 302 of the IPC. Further, the FSL report placed before this Court indicates that the DNA profile of the blood found on the clothes of the accused persons matches with that of the deceased. In view thereof, this Court finds no ground to grant bail to the Applicant at this stage. 6. Accordingly, the application is dismissed. Pending application(s), if any, also stand disposed of. 7.
