PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.7 for granting of pre-arrest bail in connection with Crime No.310 of 2025 of Vedayapalem Police Station, Nellore, SPSR Nellore District, registered for the alleged offence punishable under Sections 318(4), 336(3), 340(2), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). \ \ 2 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. This Court in CrI.P.No.11807 pf 2025 on 21.11.2025 granted pre-arrest bail to accused No.4. The defacto complainant lodged a report with the police, it was registered as a case in Crime No.310 of 2025 on 21.07.2025. The defacto complainant is one of the defendant (4*'" defendant) in a Suit instituted by him in O.S.No.271 of 2008 on the file of the learned Principal Senior Civil Judge, Nellore. However, that Suit was dismissed. The Suit was filed seeking permanent injunction against the petitioner who was representing plaintiff Nos.11 to 13 as G.P.A. Holder. Even according to the defacto complainant, a civil litigation has been pending from 2000 onwards with regard to the land. The petitioner is aged about 66 years. He is permanent resident of Nellore District. He has got fixed abode. If he enlarge on bail, he may not evade the process of law. 4. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.7. 5. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/ Accused No.7, he shall be enlarged on bail subject to he executing bond for a sum of , 3 Rs. 10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the arresting police officials: The Petitioner/ Accused No.7 shall make himself available for investigation as and when required; iii. The Petitioner/ Accused No.7 shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner/ Accused No.7 shall appear before the Station House Officer concerned once in a month i.e., on any Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. IV. The Petitioner/ Accused No.7 shall not leave the Andhra Pradesh limits without the express permission from the Station House Officer concerned. V.
