1. This is a writ petition filed under Article 226 of the Constitution of the India seeking the following prayers:-
“a. Issue a writ of Mandamus or any other appropriate writ,
order or direction quashing and setting aside the communication dated 07.10.2024 issued by the Respondent and allow the Application of the Petitioner requesting for the change of date of birth of the Petitioner from 30.07.2003 to 05.08.2003; and b. Issue a writ of Mandamus or any other appropriate writ,
order or direction directing the Respondent to correct/ rectify the date of birth of the Petitioner in Marks Statement Cum Certificate of the Secondary School Examination dated 15.07.2020 and any other document issued by the Respondent relying upon the said Certificate, after recording the correct date of birth of the Petitioner, i.e., 05.08.2003, and thereafter, issue a fresh certificate to the Petitioner after making the This is a digitally signed order. 2. The case of the petitioner is that the presently, the petitioner is pursuing Bachelor of Science in Nursing from Rachna Institute of Nursing, Nangal Sirohi, Haryana. On 09.04.2008, the petitioner was admitted to Mewat Model School, Nuh, Haryana, which is affiliated with the respondent/CBSE. Petitioner’s father while filling the admission form, inadvertently mentioned petitioner’s date of birth as 30.07.2003 instead of 05.08.2003. 3. In 2020, the petitioner appeared for his Class X examinations and in 2022, in his Class XII examinations and the respondent issued Marks Statement Cum Certificate dated 15.07.2020 for Class X, wherein petitioner’s date of birth was incorrectly mentioned as 30.07.2003. 4. Upon learning of the said error, the petitioner and his father enquired regarding the procedure for rectification and the school informed that a letter has to be issued to the School Principal, who will forward it to the respondent/CBSE. Accordingly, the petitioner wrote a letter dated 02.11.2023 to the School Principal and the school duly forwarded the said letter along with all requisite documents to the respondent/CBSE. 5. However, on 07.10.2024, the respondent/CBSE rejected the application of the petitioner. Hence, the present petition. 6. Ms. Ohri, learned counsel for the respondent/CBSE, opposes the present petition and has made submissions. 7. I have heard learned counsels for parties. 8. Annexure-P4 (Colly) (annexed with the petition), is the Birth Certificate of the petitioner, which shows the date of birth of the petitioner as 05.08.2003. (Annexure-P4 (Colly) annexed with the petition) as well as the PAN Card (Annexure-P4 (Colly) annexed with the petition), both government documents, show the date of birth as 05.08.2003. 9. Further, this Court in its earlier Order dated 11.02.2026 passed in Smt. Nisha Ray v. Central Board of Secondary Education & Anr., W.P.(C) 6554/2023, while relying on Jigya Yadav v. CBSE, (2021) 7 SCC 535 and Central Board of Secondary Education v. Prema Evelyn D Cruz and Anr., LPA171/2023, made the following observations:-
“11. Even in the judgement of Jigya Yadav (supra), the Hon’ble Supreme Court has stated that there can only be one Date of Birth. The petitioner is and should be entitled to make a correction to make the document consistent with all public documents, namely, Adhaar Card, PAN Card and the Birth Certificate. 12. In case the petition is not allowed, the petitioner would be having 2 date of births, one shown in the Adhaar Card, PAN Card and Registration Certificate and the other in the Matriculation Certificate which is impermissible and contrary to law.”

In view of the above, the present petition is allowed and the date of birth of the petitioner shall be corrected and record as 05.08.2003 in the CBSE records and school records, within 2 weeks from today. 11. Ms. Ohri, learned counsel for the respondent, relies on the order dated 09.11.2020 passed in CWP No. 18893/2020 by the High Court of Punjab and Haryana at Chandigarh. issue and is purely a procedural order and hence, not applicable. Additionally, it does not consider the effect of the Hon’ble Supreme Court Judgment in Jigya Yadav (supra). 13.
