This application under Section 419(4) of BNSS has been filed seeking for grant of leave to appeal against the impugned order dated 26.09.2024 passed by the Judicial Magistrate First Class, Bilaspur (CG) by which the criminal/complaint case filed by the petitioner/complainant was dismissed due to non-prosecution under Section 256 of CrPC, which amounts to the acquittal of the Respondent/accused from the charge of committing the offence under Section 138 of N.I. Act.
6. Considering the facts and circumstances of the case, this Court is of the opinion that arguable points have been raised by the petitioner for grant of leave to appeal.
7. Accordingly, the application seeking leave to appeal is allowed. Leave as prayed for is granted.
8. Let this CRMP now be registered as an Acquittal Appeal.
9. Trial Court record has been received.
