1. The present writ petition has been filed for issuance of direction upon the concerned respondents to provide the certified copy of khatiyan (parcha) of Jamabandi No.1 of Mouza-Kashidih No.83, P.S.-Madhupur (now Devipur), District-Deoghar recorded in the name of Ishri Rai, Jagdish Rai, Nathu Rai and others to the petitioner.

Learned counsel for the petitioner submits that the petitioner being the grandson of Nathu Rai has filed Original Suit No.259 of 2021 with respect to the aforesaid land, which is pending before the Court of Civil Judge (Senior Division)-X, Deoghar. The petitioner requires the khatiyan of the said land in the pending suit so as to establish her case in the same. Accordingly, he made requisitions in the office of the District Records Room, Deoghar, however, the same were not accepted without disclosing any reason. Thereafter, he made an application

for the said purpose in the office of the Deputy Commissioner, Deoghar-respondent no.2 on 11th November, 2024 which also remained unresponded.

It is further submitted that the aforesaid land is not the subject matter of investigation of the criminal cases lodged by the Central Bureau of Investigation i.e. RC No.15A/2012D and RC No.16A/2012D. Otherwise, also the Central Bureau of Investigation has already submitted the charge-sheet in the aforesaid cases long back, but on the pretext of the said cases, the office of District Records Room, Deoghar neither accepts the requisitions nor supplies the concerned documents unless the permission is granted by the respondent no.2. Under the said compelling circumstance, the petitioner has preferred the present writ petition.
4. Ms. Surabhi, learned A.C. to A.A.G.-II, appearing on behalf of the respondents submits that if the petitioner prefers a fresh application in this regard before the respondent no.2-Deputy Commissioner, Deoghar, an appropriate decision/step will be taken by the said respondent within a time frame.
5. Having heard learned counsel for the parties and considering the nature of the prayer made in the writ petition, without entering into merit of the case, the petitioner is given liberty to prefer a fresh application in this regard before the respondent no.2. On receipt of the

said application, the respondent no.2 shall take appropriate decision/step within six weeks from the date of filing of the application.
6. The writ petition is, accordingly, disposed of with the aforesaid liberty and direction.
