Assigned (Land Transfer of Prohibition) Act, 1977 (Act 9/1977) and consequently declare the action of 4th respondent interfering in civil matters as bad, illegal and arbitrary under Article 14, 16, 21 and 300-A of Constitution of India and to pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct to 3rd respondent not to dispossess the petitioners from the lands in their possession in respect of Ac.0-42 cents of land in Sy.No.291-1, an extent of Ac.2-87 cents in Sy.
No. 291-1, and extent of Ac.0-84 cents in Sy.No. 34 total which comes to Ac. 4-47 cents of Zeroyathi land of Zillelapudi Village, Nathavaram Mandal, Anakapalli District pending disposal of the above Writ Petition and to pass Counsel for the Petitioner(S):

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the high handed action of the 3rd and 4th respondents in not following due process of law as contemplated under the Land Encroachment Act or A.P. Assigned (Land Transfer of Prohibition) Act, 1977 (Act 9/1977) and consequently declare the action of 4th respondent interfering in civil matters as bad, illegal and arbitrary under Article 14, 16, 21 and 300-A of Constitution of India and to pass.…”
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioners would submit that the police are interfering in the civil disputes between the petitioners and the unofficial respondents. Learned counsel would further submit that a direction may be given to the police.

Learned Assistant Government Pleader for Home, on written instructions would submit that based on the complaint made by respondent No.5, a case in Cr.No.213 of 2022 for the offences punishable under Sections 447, 324, 506 r/w 34 of IPC. A counter-case made by 3rd petitioner, a case in Cr.No.214 of 2022 for the offences punishable under Sections 324, 323 r/w 34 of IPC was registered against the unofficial respondents. He would further
submit that police are not interfering in the civil disputes between the petitioners and the unofficial respondents.

Learned counsel for the petitioners would submit that recording the same, the petition may be disposed of.
6. Recording the above said submissions, the Writ Petition is disposed of. However, police are directed not to interfere in the civil disputes between the petitioners and the unofficial respondents, except under due procedure of law. There shall be no order as to costs.
