JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Spl.C.No.2290/2023 pending before the Court of XXXIII Additional City Civil and Sessions Judge and Special Judge (NDPS), Bengaluru, arising out of F.No.DRI/BZU/S-IV/ENQ-12(INT-NIL)/2023 registered by Directorate of Revenue Intelligence, Bengaluru Zonal Unit, Bengaluru, for offences punishable under Sections 21(c), 23(c) and 28 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act') is before this Court under Section 439 of Cr.PC seeking regular bail.

Learned Counsel for the petitioner after arguing the matter for some time submits that the petitioner is in custody for the last more than two years and he has no

There are certain procedural defects in the case of the prosecution. Therefore, he submits that the trial Court may be directed to expedite the trial in the case and dispose of the main case on merits as expeditiously as possible.

Learned counsel for respondent who has filed statement of objections opposing the bail petition submits that trial in the case has already commenced and out of the ten charge sheet witnesses cited in the present case, one witness is already examined before the trial Court as PW.1. Efforts shall be made to examine the remaining charge sheet witnesses on priority.
4. Submission made on both sides is placed on record.
5. Accordingly, petition is disposed of, with a request to the trial Court to expedite the trial in the present case and dispose of the main case on merits as
