Heard Sri Kaushal Kishor, learned counsel for petitioner and Sri Meva Lal Gupta, learned Standing Counsel for State-Respondents. 2. Petitioner is claiming arrears of salary so far as salary in the grade of Principal is concerned when he has worked as an Officiating Principal between 01.07.2010 to 30.06.2012. 3. Petitioner has earlier approached this Court by filing Writ-A No. 16751 of 2023, i.e., after more than a decade. Said writ petition was disposed of vide order dated 29.02.2024 to consider the case of petitioner. Thereafter petitioner’s claim was rejected vide impugned order dated 29.04.2024 on basis of Government Order dated 19.07.2016 and relevant part thereof is mentioned hereafter: “इस सम्बन्ध मम उलल्लेख करनना हहै कक उ०प्र० मनान्यतना प्रनाप्त बल्लेससक स्कक ल (अध्यनापकक ककी भतर, सल्लेवना शतर एववं अऩ्य) कनयमनावलल- 1975 यथनासवंशशोसधत कनयमनावलल-1977 मम इन कवदनालयक मम सहनायक अध्यनापकक कल्ले पद पर कनायररत अध्यनापकक कशो प्रधनाननाध्यनापक कल्ले पद पर पदशोन्नकत अथवना सलधल भतर ककयल्ले जनानल्ले ककी प्रकक्रियना आकद कल्ले सवंबवंध मम कशोई कनयम कवदमनान नहहीं तथना शनासननादल्लेश सवंख्यना - 1366/26-03- 92-9(9) कदननावंक 31.03.1992 कल्ले शतर सवंख्यना-09 एववं शनासननादल्लेश सवंख्यना-51 28-03-94 (6)/93 कदननावंक 31.03.1994 कल्ले शतर सवंख्यना 06 कल्ले प्रनाकवधनानक मम भल नहहीं हहै। कशकनायतल पत्र कदननावंक 12.05.2017 कफिट हशोतना हहै कक कक छ जनपदक मम सजलना समनाज कल्यनाण असधकनाररयक दनारना अकनयकमत रूप सल्ले कनयककक्ति प्रधनाननाध्यनापक कशो प्रधनाननाध्यनापक पद कना वल्लेतन भकगतनान ककयना जना रहना हहै जशो कनयम कवरूद्ध व शनासककीय धनरनाकश कना दकरूपयशोग हहै। उक्ति कल्ले अकतररक्ति यह भल सवंजनान मम लनानना हहै कक उक्ति कवदनालयक कल्ले सवंबवंध मम शनासन दनारना समय-समय पर शनासननादल्लेशक मम अनकमन्य सल्लेवना शतरवं सल्ले बनाह्य दल्लेयक कल्ले सलयल्ले मना० उच्च न्यनायनालय मम वनाद यशोसजत ककयल्ले जना रहल्ले हहै, जबकक कवदनालयक सल्ले सवंबवंसधत प्रकरणक कल्ले कनस्तनारण कना दनाकयत्व सजलना समनाज कल्यनाण असधकनारल कना हशोतना हहै। प्रश्नतगत प्रकरण मम शनासन कल्ले पत्र सवंख्यना - 1260/26-02-2015, कदननावंक 23.05.2016, पत्र सवंख्यना- 1300/26.02.2016, कदननावंक 31.05.2016 एववं सवंख्यना - 1300 (1)/26.02.2016 कदननावंक 15.06.2016 दनारना कवस्ततृत/स्पष आख्यना शनासन कशो दशो कदन कल्ले अन्दर उपलब्ध करनानल्ले ककी आदल्लेश ककी गयल हहै।” 4. Learned counsel for petitioner has not disputed that reason assigned in impugned order. However, he submits that similarly situated Teachers have been granted benefit of promotion. 5. Learned Standing Counsel appearing for State-Respondents by referring said communication submits that it was noted in the said Government Order dated 23.05.2016 that any illegal promotion will be subjected to scrutiny. 6. I have considered the above submissions. It is well settled that there is no principle of negative parity. Learned counsel for petitioner is not able to show any provision that the private Schools running under Social Welfare Department have any avenue for promotion from the post of Teachers to Principal, rather the only avenue for appointment of Principal is direct recruitment. Therefore, the claim of petitioner for promotion on the post of Principal, being contrary to rules, cannot be accepted. 7. In view of above, I do not find any reason to interfere.
