pending disposal of the above suit O.S. ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the high handed and arbitrary actions of the official respondents more particularly Respondent no. 3 to 7 in interfering in civil disputes without any manner of right whatsoever and in threatening the petitioners herein to dispossess from the possession of the properties forming part of the suit schedule property pending disposal of the suit O.S. No. 9 of 2023 on the file of the court of the learned XII Additional District Judge, Pithapuram without following the procedure established by law and further threatening and compelling the petitioners herein to settle the subject matter outside the court of law which is also the subject matter of the civil suit OS No. 9 of 2023 on the file of the court of the XII Additional District Judge, Pithapuram as illegal, arbitrary and unjust and violative of Articles 14, 19, 21, and 300 A of the Constitution of India apart from being violative of Principles of Natural Justice and consequently direct the respondents to not to interfere in civil disputes pending disposal of the above suit O.S. 2. Heard Sri M.Sri Atchyut, learned counsel for the petitioners and Sri P.Ajay babu, learned Assistant Government Pleader for Home.

Learned counsel for the petitioners would submit that, it is a case of interference of police in the civil disputes despite the pendency of civil suit filed for partition i.e., O.S.No.9 of 2023 on the file of the court of the XII Additional District Judge, Pithapuram
4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on instructions, would submit that based on the complaint lodged by Kumpatia Muni Ratnam-8th respondent, a case in Crime No.138 of 2024 under Sections 126(2), 79, 351(2) r/w 3(5) BNS was registered against the petitioners on the file of Pithapuram Rural Police Station, Kakinada District. He would further submit that the police have never interfered in the civil disputes between the parties.
5. The learned counsel for the petitioners would submit that, recording the same, the court may pass appropriate orders.
5. Recording the submissions, this Writ Petition is disposed of. However, the police are directed to follow due process of law regarding the crime which is registered against the petitioners. No order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
