ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioners, seeking the following relief:
“ ... to issue a appropriate writ, Order or direction, particularly a Writ of Mandamus declaring the action of the respondent Nos. 4 and 5 in repeatedly calling the petitioners to their police station and to visit the petitioners premises by warning to vacate voluntarily on or before 22.12.2022 otherwise ousted by force from the premises as illegal, irregular and arbitrary, without jurisdiction. violative of Articles 14 and 21 of Constitution of India and consequently direct the 3rd respondent not to interfere with the peaceful live and liberty of the petitioners and pass ...”
At the time of hearing, learned Assistant Government Pleader for Home appearing for respondent State on instructions would submit that Petitioners are wife and husband respectively. Basing on the complaint against the petitioners, respondent No.3 passed an order dated 22.09.2022 to evict the petitioners from the premises of their own house and in that connection appeal is pending before respondent No.2. In the appeal, respondent No.2 passed orders dated 25.02.2023 and therefore, the cause does not survive for adjudication and the writ petition may be disposed of.
Learned counsel for the Petitioners is in attendance.
In that that view, this Writ Petition is disposed of. No order as to costs.
Pending applications, if any, shall stand closed.
