This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner has made the following primary reliefs: "(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned Selection List dated December 28, 2023, issued by the respondent No. 4 as well as the order dated January 22, 2025, Ref. No. UPSO- II/BDO/2024-25/RO Complaint not allotting dealership of Village Paiparthara on Bhagwantpur, Khudaganj Road, Tehsil Faridpur, District Bareilly, Location Sr. No. 582 under SRMP-2023, to the petitioner. (ii) Issue any other writ in the nature of mandamus directing to the respondent authorities not to allot the dealership of the Village Paiparthara on Bhagwantpur, Khudaganj Road, Tehsil Faridpur, District Bareilly, Location Sr. No. 582." Upon perusal of the impugned order dated January 22, 2025, we find that all the allegations levelled by the petitioner, have not been considered by the respondent authority, especially the one regarding there being an encumbrance in the form of a loan of Rs.25,75,000/- taken by the lessor through Bank of Baroda. In light of the same, the impugned order dated January 22, 2025, is quashed and set aside with a direction given upon the authority concerned to grant an opportunity of hearing to the petitioner and private respondent and pass an order in accordance with, within a period of twelve weeks from date. Till the order is passed, no steps shall be taken by the authority, with regard to allotment of the petrol pump to the private respondent. With the above directions, the writ petition is disposed of.
