PRAVEEN KUMAR TADISETTI The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused No.1 and 2 on bail in Crime No.308 of 2025 of Bheemunipatnam Police Station, Visakhapatnam City, was registered against the Petitioners/Accused No.1 and 2 herein for the offences punishable 2 under Sections 64(2)(m), 318(2), 115(2), 79 and 351(3) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned counsel for the petitioners, the learned Assistant Public Prosecutor and the learned counsel for respondent No.2/legal-aid counsel. Perused the record. 3. This is the second bail application. This Court, in Crl.P. No. 9715 of 2025 dated 15.10.2025, dismissed the first bail application on the ground that the investigation was at a nascent stage. The victim/defacto complainant is aged about 27 years. The learned Legal Aid Counsel submits that the petitioners and respondent No. 2 reside in the same locality and that there is a potential threat to the life and limb of the defacto complainant/victim/ respondent No. 2. The learned Assistant Public Prosecutor submits that, after a thorough investigation, a charge sheet has been filed. It is further submitted that it may take considerable time for the learned trial Court to take up the matter for disposal and that keeping the petitioners in custody for an indefinite period would serve no useful purpose. Therefore, some stringent conditions are imposed while enlarging the petitioners on bail. 4. Considering the nature and gravity of the allegations levelled against petitioner/accused Nos.1 and 2 and in view of the fact that the charge sheet has already been filed against the petitioners, this Court is inclined to enlarge petitioner/accused Nos.1 and 2. 3 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioners/ Accused No.1 and 2 shall be enlarged on bail subject to they executing bond for a sum of Rs.50,000/- (Rupees fifty thousand only) each with two sureties for the like sum each to the satisfaction of the learned XV Additional Judicial First Class Magistrate, Bheemunipatnam. ii. The Petitioners/Accused Nos. 1 and 2 shall appear before the learned trial Court on every date of hearing without fail and shall not cause any pressure, threat, or intimidation to respondent No. 2/defacto complainant/victim. iii. The Petitioners/Accused Nos. 1 and 2 shall not enter the limits of Bheemunipatnam Police Station until the examination of respondent No. 2/victim is completed by the learned trial Court. iv. The Petitioners/ Accused No.1 and 2 shall not commit or indulge in commission of any offence in future. 6. If any of the above conditions are violated, the Investigating Officer is at liberty to approach this Court seeking cancellation of the bail granted to the petitioners. The Station House Officer, Bheemunipatnam Police Station, shall file a periodical report once in every three months before the Registrar (Judicial) until the conclusion of the trial before the learned trial Court. _________________________ DR.
