ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1 and 2 on bail in Crime No.256 of 2025 of Piler Urban Police Station, Annamayya District, registered against the Petitioners/Accused Nos.1 and 2 herein for the offences punishable under Sections 329(3), 303(2), 49, 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’), Sections 20(1)t3^0)(a) r/w 20(1 )(c)(ii), iii
2 iv, X, 32-A read with 36(a) of A.P. Forest (Amendment) Act, 2016 and Section 3 of Prevention of damage to Public Property Act, 1985.
2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. The allegation against the petitioners/accused Nos.1 and 2 is that they indulged in dealing with two red sander logs weighing 62 kgs. They allegedly acted as coolies for cutting red sander trees and converting them into logs for transportation.The petitioners were arrested on 25.10.2025 and have been in
3. judicial custody for the past 38 days. They were arrested in the village. So far. seven witnesses have been examined, all of them are material and official witnesses. Therefore, there is no possibility of the petitioners threatening the official witnesses, tampering with evidence, or hampering the investigation. No petition seeking custodial interrogation was filed by the police before the concerned Court below. Substantial portion of the investigation in so far the involvement of the petitioners concerned is completed. The petitioners are permanent residents of Vellore District. They have got fixed abode. Even if conditions are imposed, there is no likelihood of their absconding or evading the process of law. No similar adverse criminal antecedents reported against the petitioners.

4. Considering the gravity and nature of the allegations, as well as the
facts and circumstances of the case, this Court is inclined to enlarge the Petitioners/Accused Nos.1 and 2 on bail.
5. in the result, the Criminal Petition is allowed with the following stringent conditions: The Petitioners/Accused Nos.1 and 2 shall be enlarged on bail subject to they executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties for the like sum each to the satisfaction of the learned Special Judicial Magistrate of First Class Trial of cases relating to Red Sanders Smuggling, Tirupathi. I. The Petitioners/ Accused Nos.1 and 2 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. II. iii. The Petitioners/ Accused Nos.1 and 2 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. The Petitioners/ Accused Nos.1 and 2 shall not commit or IV. indulge in commission of any offence in future. The Petitioners/ Accused Nos.1 and 2 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the investigating officer as and when required. V.
4 The Petitioners/ Accused Nos.1 and 2 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. VI. The Petitioners/ Accused Nos.1 and 2 shall surrender their passport, if any, to the investigating officer. If they claim that they does not have a passport, they shall submit an affidavit to that effect to the Investigating Officer. VII.
