ORDER: This Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha sanhita, 2023, has been filed by the petitioner/A3, seeking baI-I, in crime No.14/2023 of G.Madugula Police Station, AIluri Sitharama Raju District. 2, A case has been registered againstthe petitionerand others forthe offences punishable u/Sec.20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the PrOSeCut|lOn, in brief, iS that, On 26.4.2023, at about 3.30 pm, on receipt Of rel-table infOrmat|]On, the Sub-Inspector Of Police, along with his staff and mediators, while conducting vehicle checking near MRO office junCt-Ion, G.Madugula V'lllage, found Al in suspicious circumstances. on seeing police, he tried to ran away. Then police apprehended him and on enquiry, he disclosed h'ls ident',ty part'lculars as that of Al and police found 1.5 kgs of hashish O" from his POSSeSSiOn. The contraband along With Vehicle and Other material Was Seized under cover of a mediators report and a case has been registered against the accused. He confessed the involvement Of the Petit'lOner herein/A3 and other accused in the present crime. petitioner herein was arrested on execution of pT warrant On 13,3.2025 and remanded tO jud',Cial Custody. 5. Heard. PerusedthereCOrd. 6. Learned Assistant Public Prosecutor Submits that major Part Of the investigation is completed except fil'lng of charge sheet. 7. Learned COunSel for the Petit-lOner Submits that a Crime Came tO be leg-lstered on 26.4.2023 and basing On the COnfeSSiOn Statement Of CO- accused, this petitioner was arrested on 13.3.2025 on eXeCut'lOn Of PT warrant and since then he has been in judicial custody and the same was not disputed by the leamed Assistant Public Prosecutor and Prays tO allow the criminal pet'ltion. 8. After careful Observation Of the material On record and SubmiSSiOnS made on behalf of both sides, it shows that the petitioner was arrested _-` L=
i++ ++ -ri ,Dffl '/ 3 r, and remanded to judI|Cial Custody On 13.3.2025. EvI-dently no contraband has been seized from the possession of the petitI-Oner. Since the accused has been in judicial custody from 13.3.2025, this Court found that most of the investigation pertairling to the role played by the petitioner in the commission' of the offence would be completed.
It is submitted that the Petitioner is a permanent resident of Jaipuri of Odisha State and there is no POSSibility of his fleeing away from justI|Ce and most of the witnesses are official witnesses and the release of the petitioner would not cause tampering of evidence and hampering of investigation. when ascertallned, learned Assistant public Prosecutor submitted that there js one antecedent reported against the petit.ioner. considering the entI-re material on record, this court is inclined to grant bail to the petitI-Oner With some COnditiOnS. 9. In the result, the Criminal petition is allowed with the following conditions: (I') The petitioner/A3 herein shall be released on his executing a personal bond for Rs,25,000/- (Rupees twenty fI'Ve thousand only) with two sureties for a like sum to the satisfaction of the learned I Additional District & sessions Judge-Gum-special Judge for trial of offences under NDPS Act, Visakhapatnam,r (ill) On release, the petitioner shall appear before the station House Officer concerned once in a fortnight between 10.00 a.m. and 12.00 noon, for a period of two (o2) mon{h's.
