2. The petitioner has filed this petition praying for following relief:- I. Quash and set aside the FIR bearing Crime No. 59/2023 dated 29.01.2023 under section sections 450 and 376 of I.P.C.. (Annexure-P/1) II. Quash and set aside the Final Report No. 367/2023 dated 06.07.2023 in Crime No. 59/2023 registered before P.S.-Kharora, Distt Raipur for the offence punishable under section 450 and 376 of I.P.C. (Annexure-P/2). III. Quash and set aside the Cognizance Order dated 22.08.2023 in Session Case No. 175/2023 pending before Additional Sessions Judge (FTC), Raipur (C.G.). (Annexure-P/3). IV Quash and set aside the order dated 06.10.2023 whereby learned court has framed the charges under section 450 and 376 of the I.P.C. (Annexure- P/4) V. Quash the entire criminal proceedings arising out of Crime No. 59/2023 for offences punishable under section 450 and 376 of the I.P.C. pending before Additional Sessions Judge (FTC), Raipur (C.G.) registered as Eriminat Case no. 175/2023 against the petitioners. VI. Pass such order or further order(s) as this Hon'ble Court may deemed fit, proper and just in the fact and circumstances of the present case, to secure the ends of justice.”

After arguing for some length, as the charges have also been framed, learned counsel for the petitioner seeks permission of this
3 Court to withdraw the present petition with liberty to take recourse before the learned the trial court. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with aforesaid liberty. 6. Certified copies of the FIR, charge-sheet, and other documents, if any, may be returned to the petitioner after retaining photocopies of the same.
