The petitioners have filed this application for quashing of entire criminal proceeding in connection with Mandu (Kuju O.P.) P.S. Case No.425 of 2015, registered under Sections 323, 341, 354, 384, 364, 419, 420, 467, 468 of the I.P.C. and Sections 3 / 4 of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, in which cognizance has been taken under Sections 341, 323, 354, 504, 506 of the I.P.C. and Sections 3 / 4 of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act. Mr. Nehru Mahto, learned counsel for the petitioners and Mr. Alok Lal, learned counsel for the opposite party No.2 submitted that the victim has compromised the case with the petitioners. However, he submitted that the victim is not the informant of this case and informant has already died. Learned counsel for the petitioners further submitted that charge has already been framed in this case. Considering the facts that the offence under Section 354 of the I.P.C. is not compoundable in nature. No case for quashing of criminal proceeding of Mandu (Kuju O.P.) P.S. Case No.425 of 2015 is made out. Accordingly, this Cr. M.P. is dismissed. -2- Pending, I.A. if any, stands disposed of. The petitioners shall appear before the learned court below on the next date fixed. The learned court below shall expedite the trial by recording the statement of the victim as expeditiously as possible. (Ambuj Nath, J.) Jay/-
