...PETITIONER/ACCUSED AND THE STATE OF ANDHRA PRADESH, Rep.by its Public Prosecutor, High Court of AP, Amaravathi. ...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused:
1. B V KRISHNA REDDY Counsel for the Respondent/complainant:
1. PUBLIC PROSECUTOR COMMON ORDER:
These two Criminal Petitions are heard and disposed of by this common order as the case is arising from same crime and the petitioners are different. 2. The Criminal Petitions have been filed under Section 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to enlarge the petitioners/Accused Nos.3 to 5 on bail in Crime No.337 of 2025 of Machavaram Police Station, NTR Commissionerate,
3 Dr. YLR, J Crl.P.Nos.11139 & 11209 of 2025 Dated 07.11.2025
registered against the petitioners/Accused Nos.3 to 5 herein for the offences punishable under Sections 194 of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 3. Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor. 4.
The learned counsel for the petitioners submits that the petitioners /Accused Nos.3 to 5 have not committed any offence and they were falsely implicated in this case and they would abide by any conditions to be imposed by this Court if they are enlarged on bail and they are the sole bread winners of the family. Hence, it is urged to enlarge the petitioners on bail. 5. Per contra, Ms. Akhila Naidu, learned Assistant Public Prosecutor submits that the investigation is at nascent stage and some more witnesses are need to be examined as per the submission of the LW 3, 9 and 10 and urged this Court to dismiss the petitions. 6. Accused Nos.4 and 5 are the brothers of the A-3, who is the wife of A-1. The 2nd son of the defacto complainant and daughter of petitioners/A-3 loved each other. She is aged about 17 years. The Accused Nos.1 to 14 are arrested on 15.09.2025 and they have been in Judicial custody for the past 52 days. L.W.3 is the individual eye witness. 4 Dr. YLR, J Crl.P.Nos.11139 & 11209 of 2025 Dated 07.11.2025
L.W.9 and 10 also supported averments of the report lodged by the defacto complainant. So far, only 10 witnesses are examined and investigation is at nascent stage and some more witnesses are need to be examined. Enlarging the petitioners at this juncture would not only hamper the further investigation but also scarce the prosecution witnesses. Hence the request of the petitioners is not found convincing and reasonable. Hence the criminal petitions are liable to be dismissed. 7. Considering the gravity and nature of the allegations, as well as the facts and circumstances of the case, this Court is not inclined to enlarge the Petitioners/ Accused Nos.3 to 5 on bail at this stage. 8. In the result, the Criminal Petitions are dismissed. _______________________ DR. Y. LAKSHMANA RAO, J Date: 07.11.2025 RSD
