This is the third bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 65/2024 registered at Police Station Singhoda, District- Mahasamund (C.G.) for the offence punishable under Section 20 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief, is that on the basis of information received through informant, the Police of Police Station – Singhoda has allegedly recovered 3 Kgs of cannabis from the possession of the applicant. Thereafter offence punishable under Section 20 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 has been registered against the present applicant. 4. Learned counsel for the applicant submits that the earlier two bail application was dismissed by this Court on the ground that the present applicant has one more criminal antecedents under the NDPS Act and the said case is still pending. He further submits that as per the status of the trial, the trial is in progress and out of 17 prosecution witnesses, statement of 06 witnesses have been recorded. He later submits that the applicant is in jail since
10.06.2024. Hence, he prays for grant of bail to the applicant. 5. On the other hand, the learned counsel for the State opposes the bail application and submits that the earlier two bail applications was rejected by this Court on the ground that the present applicant has one more criminal antecedents under the NDPS Act and the said case is still pending. Hence, this bail application is liable to be rejected. 6.
I have heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case that though the earlier two bail applications was rejected by this Court on the ground that the present applicant has one more criminal
3 antecedents under the NDPS Act and the said case is still pending and as per the status of the trial, out of 17 prosecution witnesses, statement of 06 witnesses have been recorded, further the applicant is in jail since 10.06.2024, but considering the fact that one more case is pending against the applicant under the NDPS act and the first two bail applications was rejected on the said ground, no new ground has been raised by the applicant, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the third bail application of the applicant- Prashant Sultaniya filed under Section 483 of BNSS, involved Crime No. 65/2024 registered at Police Station Singhoda, District- Mahasamund (C.G.) for the offence punishable under Section 20 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected at this stage. 9. The office is directed to provide a certified copy of this order to the trial Court for necessary information and compliance forthwith. -
