JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred under Section 483 of BNSS, 2023, to enlarge the petitioner on bail in Crime No.103/2025 of Vidyanagar Police Station, Davanagere. 2. Heard both the sides and perused the material on record. 3. It is the case of prosecution that due to previous enemity, all the accused conspired with each other to commit the murder of first informant's husband - Santosh Kumar and in furtherance of the same, they travelled in different vehicles on 05.05.2025 at about 5.00 p.m., and when the deceased was in one Power Sports and Recreation Association Club, situated opposite Someshwara Hospital, Hadadi Road, Davanagere, brutally attacked and hacked him to death. - 3 - HC-KAR NC: 2025:KHC:39162 CRL.P No. 12929 of 2025 4. FIR is registered on the basis of a complaint lodged by Smt.Shruthi T.K. wife of the deceased, against 12 named and other unnamed accused persons, for the offence punishable under Sections 103, 189(2), 190, 191(2), 191(3) of BNS, 2023. 5. Petitioner is not specifically named in the FIR. Charge sheet is filed against 20 accused wherein petitioner is arraigned as accused No.17. 6. The case of the prosecution is that, accused No.1 harboured long-standing animosity against the deceased and further, there was some difference between the petitioner and the deceased in relation to some real estate transaction. It is alleged, deceased had scolded the petitioner, hence, he was waiting for an opportunity to eliminate him and when he contacted his friends, CW.15 and CW.16, they suggested the name of accused No.1 to carry out the plan. - 4 - HC-KAR NC: 2025:KHC:39162 CRL.P No. 12929 of 2025 7. Learned HCGP has contended that petitioner has conspired to commit the offence and supplied weapons to other accused persons. He contended that CWs.27 to 43 are the eye witnesses to the incident and in view of the nature and gravity of the offence, petitioner is not entitled for bail. 8. Admittedly, the petitioner is not one of the assailants. The allegation that there was some enmity between the deceased and petitioner in relation to a real estate business and the deceased had earlier threatened the petitioner and therefore, he was nurturing ill-will against him etc., is a matter which has to be established in due course. It appears that from the voluntary statement of the co-accused, the prosecution has alleged that the petitioner has conspired to finish the deceased and he supplied weapons to other accused. Except that, at this stage, there is no material worth forthcoming to deny the relief sought in the petition. It is not the case of prosecution that the - 5 - HC-KAR NC: 2025:KHC:39162 CRL.P No. 12929 of 2025 petitioner was present at the spot, when the deceased was killed. It is no doubt true that the alleged role of the petitioner in providing finance and weapons for eliminating the deceased is grave. However, except the allegations, there is no other material at this stage to substantiate the same, to show a prima-facie case against the petitioner. For the above reasons, the following: ORDER Petition is allowed. Petitioner/accused No.17 in Crime No.103/2025 of Vidyanagar Police Station, Davanagere, shall be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform - 6 - HC-KAR NC: 2025:KHC:39162 CRL.P No. 12929 of 2025 the Court, if there is change in the address. 3. He shall not leave the jurisdiction of the trial Court without prior permission of the learned Sessions Judge. 4. He shall not tamper with the prosecution witnesses either directly or indirectly. 5.
