ORAL ORDER
This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in Crime No.100/2025 of Mangalore North Police registered for the offence punishable under Section 109 of BNS. 2. Heard learned counsel for petitioner and learned Addl.SPP for respondent / State. 3. Learned counsel for petitioner would contend that there was a quarrel between the petitioner and the injured with regard to bringing of Maida. There is no intention on the part of the petitioner to kill the injured. The injured who was admitted on 27.08.2025 has been discharged on
01.09.2025. Only one injury is stated to be grievous in nature. There are no criminal antecedents of the petitioner. Petitioner is the only earning member of the

family and he is having children. With this he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that there are five injuries sustained by the injured and they are on chest, abdomen and forearm. Chest and abdomen are vital parts of the body. The assault is made by knife. There are several eye witnesses. The knife has been seized and as per FSL report it is blood stained. The investigation is in progress. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record. 6. The petitioner is working as a Cook and the injured is working as waiter in Hotel Paakashala at Mangaluru. There was quarrel between the petitioner and the injured at 4.00 p.m. on 27.08.2025 with regard to brining of Maida. Thereafter at about 11.30 p.m., the

injured was taking rest. At that time, this petitioner went there with a knife and assaulted him on his chest, stomach and caused injuries. The wound certificate of the injured indicate that he has sustained five injuries. Out of them three injuries are on the chest and one injury is on the abdomen and another injury on the left forearm. The weapon used is knife and injury caused is on abdomen and chest and they are vital parts of the body and that indicates the intention of the petitioner. There are eye witnesses to the incident.
The investigation is in progress. Therefore, at this stage, the petitioner is not entitled for grant of bail. In the result, the petition is dismissed. Sd/- (SHIVASHANKAR AMARANNAVAR) JUDGE
