By means of this petition filed under Article 226 of the Constitution, petitioner, who is working as Medical Officer in the Provincial Health Services of the State is seeking consideration of his claim for promotion to Level - III Medical Officer position in the State Medical and Health Services in view of the recommendations made by Chief Medical Officer, Chandauli on 28.03.2025, as according to him, many juniors to him have already stood promoted to that level. It is submitted that consideration to this effect is to be finally accorded by the State Government only upon the recommendation to be further made by the Director General. Learned Standing Counsel submits that in the first instance, since the matter is engaging attention of the Director General, Medical Health and Family Welfare, Government of U.P., Lucknow, the said respondent may be directed to decide the claim of the petitioner in accordance with law. In view of the above, this petition stands disposed of with a direction that respondent no. 2 to look into and consider the claim of representation of the petitioner dated 07.01.2025 forwarded by the respondent no. 3 on 28.03.2025 for promotion to Level - III Medical Officer in the Provincial Medical and Health Services and in the event petitioner's claim is found to be rightful and genuine, the same shall be accorded approval by the State Government within a further period of two months.
