BAIL APPL. NO. 4323 OF 2025 3 2025:KER:27998 P.V.KUNHIKRISHNAN, J ............................................ B.A.No.4323 of 2025 ...................................... Dated this the 2nd day of April, 2025 ORDER This bail application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
2. By order dated 05.03.2025 in B.A.No.2858/2025 this Court allowed the petitioner to file a fresh bail application. Therefore, petitioner filed a fresh application as Crl.M.P.No.1081/2025 in S.C.No.805/2024 before the Additional Sessions Court-VIII, Ernakulam. By an order dated 19.03.2025, the Additional Sessions Court-VIII, Ernakulam, dismissed the application stating that this Court had previously directed in an earlier bail application that the trial be completed within six months and that the court is taking steps to ensure the trial is completed. Therefore, this bail application need not be entertained now. But I make it clear that if the trial is not completed within six months as directed by this Court in B.A.No.1337/2025, petitioners can file a fresh bail application and the learned Sessions Judge will allow the same, without undue delay. With the above observation, this bail application is disposed of. sd/-
