Order on Board Per Ramesh Sinha, Chief Justice 29-01-2025
1. The present petition has been filed seeking the following relief(s):-
“I0.1 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondents no.4 & 5 to comply with the memo dated 26.06.2024 issued by the respondent no. 3 (Annexue P/6). 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent no. 2 to take proper action against the respondent no. 6 for doing illegal plotting of agricultural land, forthwith. 10.3 To kindly grant any other relief which may be deem fit in the given facts and circumstances of the instant case.
2.
Learned counsel for the petitioner submits that the petitioner having grievance against the private respondent has lodged an FIR against him and others which is pending investigation and registered as Crime No.109/2024 at Police Station Amleshwar for offence punishable under Section 420, 34 of the IPC. The petitioner has come up before this Court with the aforesaid prayer as he apprehend that if the private respondent is allowed to sell the land in question it would cause irreparable loss to him.
3. Considering the submission made by learned counsel for the
3 petitioner and further considering the fact that there appears to be some dispute between the petitioner and private respondent/respondent No.6 for which an FIR has been lodged, we are not inclined to interfere in the matter. Accordingly, the present petition is dismissed leaving it open to the petitioner to approach the appropriate forum for redressal of his grievance.
