The present writ petition has been filed by the petitioner assailing the order dated 17.10.2025 by which the petitioner has been transferred from the post of In-charge Circle Organizer Block – Sitapur to his substantive post of teaching at Govt. Primary School, Nadipara, Block – Batauli, District – Surguja. 2. Learned counsel for the petitioner would submit that respondent No. 8 is hostel Superintendent who has been posted in his place whereas the petitioner has been given the charge after obtaining NOC from the Joint Director as well as the District Education Officer. Evenotherwise, he has been posted by the Commissioner, therefore, the Collector has no jurisdiction to transfer the petitioner to his original place of posting as teacher, therefore, would pray for setting aside the transfer order. 3. On the other hand, learned State counsel would submit that the appointment of in-charge does not confer any right to the petitioner. The petitioner has been rightly transferred to his substantive post of teacher which does not warrant interference by this Court and would pray for dismissal of the writ petition. 4. I have heard learned counsel for the parties and perused the record with utmost satisfaction. 5. The petitioner has been transferred to his substantive post of teacher, as such, no service condition or fundamental rights of the petitioner has been violated. Therefore, I am of the view that no illegality or irregularity has been committed by the respondents in transferring the petitioner which warrants interference by this Court. 6.
