This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue order, direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents in not taking action on the complaint given by the petitioner on 07.06.2025 as illegal, arbitrary and contrary to the provision of BNSS and consequently direct the respondent police to register the complaint dated 07.06.2025 against the unofficial respondent and take action in accordance with law and to pass...”
2. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner.
3. Learned Assistant Government Pleader for Home, on written instructions, would submit that on receipt of complaint made by the petitioner, the police have conducted enquiry and came to a conclusion that the subject matter is purely civil in nature.
4. For ready reference, the written instructions are extracted hereunder:
“It is respectfully submitted that all the allegations leveled by the petitioner Valaboju Krupathi Rao are purely civil matters not a criminal one. However, to prevent law and order issues, the respondent No.4 i.e., Inspector of Police, Kukkunoor addressed letter to the Tahsidar, Kukkunoor and obtained enquiry report upon the accurate owner of the land and advised both parties to settle their disagreements / civil disputes before the court of law as the involvement of police in civil matters is prejudice.”
5. Recording the said submissions, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
