JUSTICE GAUTAM KUMAR CHOUDHARY For the Petitioner : Mr. Saurabh Shekhar, Advocate For the State : A.C. to A.G. ------ Order No.04 / Dated : 25.04.2025 The writ petitioner has sought for refuge in this Court for protection of his life from extremist threat. 2. It is submitted by learned counsel on behalf of petitioner that he is in the business of transportation of coal and one of the Directors of Lakshya Coal and Transportation Private Limited, which has its registered office at Pankhuri, Sarubera, Hazaribagh. 3. It is contended that the petitioner is facing impending and eminent threat to his life and property from the different extremist group, who make extremist claim from businessman and transporters. Petitioner is receiving WhatsApp messages regarding extremist demand and a press release has also been issued (copy of which has been annexed as Annexure- 2 & 3 with the writ petition) against coal transporters by the left-wing extremist organization. In this regard, he had earlier moved Superintendent of Police, Ramgarh (copy of which has been enclosed as Annexure 5), but till date no action has been taken so as to ensure security and inspire confidence of the 2025:JHHC:12451 petitioner to the security of his life. 4. Circular No.1374 dated 11th March, 2003 of the Department of Home, Government of Jharkhand, specifically provides that police security can be provided to a private person after the threat assessment is made by a committee constituted by District Level Committee, headed by the Commissioner of the Division. 5. Learned counsel confines his prayer on behalf of the petitioner that his case be referred to the said District Level Committee so that after proper assessment, he can be provided security from the threat which he is facing on day-to-day basis. 6. Having considered the submissions advanced on behalf of the petitioner, the matter is referred to the District Level Committee headed by the Commissioner of the Division to make an assessment of the threat faced by the petitioner so that appropriate steps can be taken as per the Circular. Writ Petition is accordingly, disposed of. The Divisional Commissioner, North Chotanagpur Division, Hazaribag will ensure that the Committee takes up the matter within eight weeks of the order. The petitioner will present himself before the Divisional Commissioner on 7th May, 2025 for further steps as per order. Interlocutory Application, if any, is disposed of. (Gautam Kumar Choudhary, J.)
