THE BRANCH MANAGER, ANDHRA BANK, INDUSTRIAL ESTATE BRANCH, BHIMAVARAM TOWN, WEST GODAVARI DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of Respondent Nos.l to 5 in not considering the representations, dated : 04-11-2013, 23-12-2013, 05-06-2014, Nil, 20-10-2014 and 20-10-2014 of the EMU Bird farmers to waive the loans, which were sanctioned by the 3rd RespondentNABARD pursuant to the introduction of schemes by the 1 st Respondent-Central Government and also action of the Respondent No.6 Bank in insisting for repayment of loan amount, pending decision of 3rd Respondent-NABARD ON the recommendations made by the 5th Respondent-State level Bankers committee, dated : 14-02- 2014 as illegal, arbitrary, unconstitutional, violation of principles of natural justice, and violation of Article 14, 19 of the Constitution of India and consequently direct the Respondent No.6 Bank not to insist the petitioner for repayment of loan amount till a decision is taken by 3rd Respondent-NABARD on the recommendations made by the 5th Respondent-State Level Bankers Committee, dated : 14-02-2014 and further direct the Respondent Nos.1 to 5 to waive the loan, which was advanced to the petitioner by directing the Respondent No.6 Bank not to harass the petitioner for repayment of loans and pass such other order or orders as this Hon'ble Court may deemed fit and proper in the circumstances of the case.
