1. This hearing has been done through hybrid mode. 2. The present petition has been filed by the Petitioner inter alia impugning the minutes of meeting of the TVC held on 17th December, 2024 whereby the TVC decided that all street vendors who are being surveyed be considered as ‘mobile vendors’. 3. The Petitioner in this case has a provisional CoV bearing URI 6099235 in the category of ‘Others’, for City- SP Zone, Ward- 88-N.
4. The Petitioner is a vendor outside the G.B. Pant Hospital and some images of the Petitioner’s vending site have been filed by the MCD, which are extracted below: This is a digitally signed order. 5. The Petitioner claims to be 60% disabled. 6. A perusal of the images would show that the vend of the Petitioner is right outside the G.B. Pant Hospital and could cause considerable inconvenience to the patients and the visitors. 7. Under these circumstances, two weeks time is given to the Petitioner to convert his vend into a mobile vend and to move a little further ahead in the area so that the traffic is not stopped for entry and exit of the G.B Pant This is a digitally signed order. Hospital. 8. Since, he is a disabled person, he is permitted to keep the mobile vend at a particular place as may be identified by the Assistant Commissioner, MCD in the same vicinity itself. 9. The remaining conditions that the Petitioner shall adhere to are as under: i. Petitioner shall not make any permanent or temporary construction, ii.
He shall maintain cleanliness around the vend and he shall not sub-let the vend, iii. He shall adhere to the terms and conditions of the CoV. 10. Subject to the above conditions being followed, the Petitioner’s vend shall not be disturbed. 11. Insofar as the prayer for conversion of the vends to stationary vends are concerned, the TVC, upon being constituted, shall consider the said representation and decide the same in three months. 12. The above order shall be subject to the decision of TVC-2, which is to take a decision on the total vending plan in the MCD areas of Delhi. 13. No vested rights shall be created by this order and the same shall be subject to the decision of the TVC. 14. The present petition is disposed of in said terms.
