SRINIVASA RAO NARRA Counsel for the Respondent/complainant.- 1.F]uBLIC PROSECUTOR The Court made the following: This Criminal Petition under Sections 480 and 483 of BNSS, has been filed by the petitioner/A3 seeking regular bail in Crime No.25 of 2025 of Prohibition and Excise Station, Guntur-ll, registered for the offences punishable under Sections 8(c) read with 21 (C) and 20(B)(ii)(A) I of the NDPS, Act. 2. Brief facts of the case are that, on 18.02.2025, on receipt of credible information, the Prohibition and Excise Inspector, along with his staff and mediators, rushed to Empty site located at Right side of Venkateswara Swamy Temple, Brundavan Gardens and observed two male persons. On seeing them, they perturbed and tried to skulk away, on suspicion, the police caught hold them and enquired them in the presence of mediators after duly complied the procedure, they seized 1.25 grams of Meth from the possession of A4 and seized 1.27 grams of iJtsji= €_±
r/ Meth from the possession of A5 admitted the guilt of offence.
Their confession leads to recovery of total 8.15 grams of Meth (total 9.42 grams of Meth) in seven plastic zip, lock cover from the possession of the accused and also 1 kg of dry ganja, 9 smart phones, one brown colour paper cover contaI'ning electronic Weighing machine-Iinix note book, one card board box containing one glass hookah pipe, one empty glass vessel, two empty plastic bottles and four plastic covers containing small covers .and one Honda Activa 5G two wheeler bearing Chasis No.ME4JF50AGJT 311574 under cover of media{ornama, arrested the accused and remanded to judicial custody. 3. Heard. Perused the record. 4. Learned' counsel for the petitioner submits that similarly placed person l'.e. A9 has obtained regular bail by this Court in the very same crime, vide order I-n Crl.P.No.2655 of 2025, dated 19.03.2025. The case of the present petitioner herein i.e. A3 is also on the same footing as that ofA9. 5. On the other hand, Learned Assistant Public Prosecutor has no{t disputed the said submissions made by the learned counsel for the petitioner. 6. As see'n from the record, the petitioner herein is aged about 20 years and pursuing his studies and in the said facts of the case, this q7fiZZZ» '--I ~s©
court is of the opinion that the release of the Present Petitioner WOuld not hider the investigation in anyway. 7. ln VieWOfthe aforesaid facts and Circumstances Of the Case, Since A9 who iS On the Same footing aS Of Petitioner herein/A3 was released on bail, this court is inclined to grant bail tO Petitioner herein/A3. 8. ln the result, this Criminal Petition iS allowed in the following terms. i. The petitioner herein/A3 shall be enlarged On bail On executing a personal bond for a sum of Rs.10,OOO/-(Rupees Ten Thousand only) With two Sureties Of the like Sum each tO the satisfaction of the learned special Judicial Magistrate Of First class for Prohibition & Excise, Guntur. ii.
