Dipti Jena and another …. Petitioners Mr. Bhagaban Behera, Advocate -versus- The Collector-cum-District Magistrate, Jagatsinghpur and another …. Opp. Parties Mr. Manmaya Kumar Dash, Additional Standing Counsel
CORAM:
JUSTICE K.R. MOHAPATRA
JUSTICE SANJAY KUMAR MISHRA
ORDER
Order No. 11.03.2026
3.
1. This matter is taken up through hybrid mode.
2. Petitioners in this writ petition prays for the following relief:-
“It is therefore prayed that your lordships would be graciously pleased to admit this writ petition, condone the delay and issue direction urging upon the learned District Judge by way of writ of mandamus to accept the appeal against the orders of the Collector, Jagatsinghpur passed in Misc. Case No.2/2024 and to dispose of the same within a stipulated period to meet the ends of justice;
And pass any other appropriate
order/orders, writ/writs, direction/directions as this Hon’ble Court may deem just and proper in the interest of justice;
And for which act of kindness, the petitioners shall as in duty bound every pray.”
3. It is submitted by the learned Counsel for the Petitioners that he intends to file an appeal against the order dated 5th September, 2024 passed by the Collector & District p. 2 Magistrate, Jagatsinghpur in Misc. Case No.02 of 2024, which was initiated pursuant to the order passed in W.P.(C) No.2617 of 2024.
4. Since the Petitioners could not satisfy as to under which provision such a proceeding was initiated and under which provision an appeal would lie to the concerned District Judge, the consideration of question of condonation of delay before this Court does not arise. It is more so because no proceeding against the order of the Collector & District Magistrate, Jagatsinghpur is pending at present.
5. Accordingly, the writ petition being misconceived, is dismissed.
