GP FOR HOME (AP) 4 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 2950 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue a writ or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the Police Authorities in interfering with the Petitioners peaceful life and enjoyment and harassing and confining the petitioners and their family members in the Police station in the name of investigation without following procedure contemplated under Section 41 A Code of Criminal Procedure by saying that they will foist false series of Criminal cases against Petitioners and threatening to withdraw the W.P.No. 588 of 2023 before this Hon’ble Court and H.R.C.No. 1361 of 2023 on the file of Hon’ble A.P. Human Rights Commission and not to obstruct laying of Road across Goddess Sattemma temple land as highly as illegal and unconstitutional and violation of Articles 14, 19 and 21 of the Constitution of India apart from violation of Principles of Natural Justice and consequently direct the respondents not to interfere with the petitioners’ peaceful life and enjoyment by any manner.…” 2. Heard Sri Rambabu Koppineedi, learned counsel for the petitioners and Sri V.Farook, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that a case was registered against the petitioners basing on the statement of one Sri Bonam Ramanjaneyulu, vide Cr.No.41 of 2024 under Sections 323, 324 r/w 34 of IPC on 23.01.2024. He would further submit that except for the purpose of investigation in the above crime, the police never harassed the petitioners. 5 4. Recording the same, this Writ Petition is disposed of. However, the police are directed to follow the due process of law regarding the crime which was registered against the petitioners. There shall be no order as to costs. .
