JUSTICE GANESH RAM MEENA
Order 26/05/2025
1. This appeal has been filed by the State against the impugned
judgment dated 31.03.2014 passed by the learned District Judge, Tonk in Reference Case No.57/2010.
2. The Court vide order dated 09.03.2017 was ordered to issue notice to the sole respondent. The Court further ordered that the appellants-State shall submit the required PF & notices within a period of one week.
3. On perusal of the reports of the Registry, the Court finds that the required PF & notices have not been filed even after passing of more than eight years.
4. On 31.08.2023, counsel appearing for the State prayed for and was granted two weeks’ time to submit the required PF & notices but unfortunately even after passing of 21 months
[2025:RJ-JP:22131] (2 of 2) [CMA-2879/2014] thereafter, the required PF & notices have not been filed by the State.
5. Today, even in second round no one appears on behalf of the appellants-State.
6. It is glaring case of negligence towards litigation by the State and so also the supervisory negligence of Law & Legal Affairs Department, Government of Rajasthan.
7. Not making any sincere efforts by the State towards the litigation filed by the State itself and the appeal being posted time and again and allowing to the State to submit the required PF & notices again and again for a period of 7-8 years, in an opinion of this Court, can be wastage of valuation time of the Court meant for the litigants and it seems that the State of Rajasthan does not want to prosecute this appeal.
8. Accordingly, this civil misc. appeal stands dismissed with a cost of Rs.1,00,000/- to be deposited by the State with the Litigants Welfare Fund.
9. Pending application including stay application also stand
disposed of.
11. Copy of this order be sent to the Chief Secretary, Government of Rajasthan, Secretariat Jaipur and the Principal Secretary, Law & Legal Affairs Department, Government of Rajasthan for effective supervision of the litigation by and against State.
