The present writ petition has been filed for issuance of direction upon the concerned respondents to provide the certified copies of khatiyan (parchas) of Jamabandi No.59 of Mouza-Satar Khorpos No.385-387 recorded in the name of Mahadev Deo & Others as well as Jamabandi No.93 of Mouza Satar No.377 within Kunda P.S., District-Deoghar recorded in the name of Mahadev Deo and Janki Devi to the petitioner. 2. Learned counsel for the petitioner submits that the petitioner being the daughter-in-law of Mahadeo Deo has filed Original Partition Suit No.333 of 2022 with respect to the aforesaid lands, which is pending before the Court of Civil Judge (Senior Division)-II, Deoghar. The petitioner requires the khatiyan of the said lands in the pending suit so as to establish her case in the same. Accordingly, she made requisitions in the office of the District Records 2025:JHHC:10185 2 Room, Deoghar, however, the same were not accepted without disclosing any reason. Thereafter, she made an application for the said purpose in the office of the Deputy Commissioner, Deoghar-respondent no.2 on 23rd December, 2024 which also remained unresponded. 3. It is further submitted that the aforesaid lands is not the subject matter of investigation of the criminal cases lodged by the Central Bureau of Investigation i.e. RC No.15A/2012D and RC No.16A/2012D. Otherwise, also the Central Bureau of Investigation has already submitted the charge-sheet in the aforesaid cases long back, but on the pretext of the said cases, the office of District Records Room, Deoghar neither accepts the requisitions nor supplies the concerned documents unless the permission is granted by the respondent no.2. Under the said compelling circumstance, the petitioner has preferred the present writ petition. 4. Ms. Rishi Bharati, learned A.C. to A.A.G.-III, appearing on behalf of the respondents submits that if the petitioner prefers a fresh application in this regard before the respondent no.2-Deputy Commissioner, Deoghar, an appropriate decision/step will be taken by the said respondent within a time frame. 5. Having heard learned counsel for the parties and considering the nature of the prayer made in the writ petition, without entering into merit of the case, the 2025:JHHC:10185 3 petitioner is given liberty to prefer a fresh application in this regard before the respondent no.2. On receipt of the said application, the respondent no.2 shall take appropriate decision/step within six weeks from the date of filing of the application. 6.
