GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... writ of Mandamus declaring the inaction on the part of the respondents i.e., respondents 2 to 4 in not registering the crime against the respondents 5 to 8 on the petitioner's complaint, dated 01.02.2021 against the culprits named therein, as illegal, irregular, irrational, amounts to non discharge of legal obligation conferred on respondents 2 to 4 under the provisions of Code of Criminal Procedure, 1973 and offends Article 14 of Constitution of India and consequently direct the respondents 2 to 4 to register the crime and prosecute the offenders for appropriate offences and penal provisions of law.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, since the death of her husband, the Petitioner left the matrimonial house and has been living in her parental home and did not come to her in-laws’ house. It is further submitted that, the Petitioner requested for property share of her husband. Hence, the matter is of civil nature, as such, Police have not registered any case based on the complaint given by the Petitioner. 3. Sri B.Suryanarayana, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before the appropriate forum in accordance with law. There shall be no order as to costs.
