This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.410/2024, registered at PS -Urga, District Korba Chhattisgarh, for commission of offence punishable under Sections 103(1), 115(2) of BNS (corresponding Sections 302, 323 of IPC). 2. Case of prosecution, in brief, is that present applicant has committed murder of his step son (aged about four year) and also 2 assaulted his wife. Based upon report, FIR was registered and accused-applicant has arrested for the aforementioned crime/offence. 3. Learned counsel for the applicant submits that applicant has been falsely implicated in this case, he has not committed any offence as alleged against him. There is no evidence/material available to connect this applicant in the instant crime/offence. On the date of alleged incident, wife of present applicant was going to her parental home alongwith the child and he (applicant) was trying to stop her by snatching the child from her, due to this scuffle, child was dropped from the hand of wife (informant) and he received some injuries on his head, due to which, he succumbed to the injuries and this version is also corroborated by post-mortem report of deceased child which shows that scratches marks were present on the various parts of the body of the deceased and he was died due to cranio- cerebral injuries. Applicant is in jail since 13.10.2024, conclusion of trial may take some time, hence, applicant may be released on bail. 4. Per contra, learned State Counsel opposing the bail application of the applicant and submit that on the date of incident, applicant has committed murder of his step son Vihan (aged about four year) by strangulating and beating him on the ground in his own house and also assaulting his wife (Ramshila), hence, he is not entitled for grant of bail. 5. Heard learned counsel for the parties. 3 6. Considering facts of the case, nature of offence, submissions of learned counsel for the parties, particularly that applicant has committed murder of his step son Vihan (aged about four year) by strangulating and beating him on the ground in his own house and also assaulting his wife (Ramshila), I am not inclined to allow this bail application. 7.
