THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.1015 OF 2025 ORDER: This Criminal Petition, under Section 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4, seeking bail, in Crime No.39/2023 of Paderu Police Station, Alluri Sitharamaraju District. 2. A case has been registered against the petitioner and others for the offences under Sections 20(b)(ii)(C) r/w 8(c), 25 of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution is that on 28.3.2023 at about 5.00 p.m., on receipt of credible information regarding illegal possession and transportation of ganja, S.I of Police, along with staff, rushed to Chinthalaveedhi junction, Paderu Village and started vehicle checking. At that time, they found one Maruti Ertiga Car bearing registration no.OD 10 N 0376 coming. On seeing police, the inmates in the car tried to run away. But the police apprehended them and on enquiry, they disclosed their identity particulars and police seized 110kgs of ganja from them. They confessed that the petitioner acted as a mediator between them for purchasing the ganja and police arrested the petitioner/A4 on 28.10.2024 and got remanded him to judicial custody. 2 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that the petitioner is involved in two other cases pertaining to NDPS Act and the petitioner is a habitual offender. 6. A perusal of the material available on record goes to show that the petitioner was arrested on 28.10.2024 and as stated by the learned Assistant Public Prosecutor that the petitioner is involved in two other NDPS Cases and if he is enlarged on bail, there is every possibility of his tampering with evidence and hampering of investigation. Hence, this Court is not inclined to grant bail to the petitioner, at this stage. 7. Accordingly, the Criminal Petition is dismissed. _______________________ K.
