ORDER This writ petition has been filed seeking a writ of Certiorarified Mandamus to call for the records relating to the order passed by the 1st respondent in his proceedings ROC.No.A1/26854/2018 dated 17.10.2024, whereby the revised Deputy Tahsildars list for the year 2017 has been drawn, i.e., preparing the panel for promotion in the cadre of Deputy Tahsildar for effecting promotions to the post of Tahsildar, on the ground that the said panel has been prepared by following the roster system instead of following the merit list published by the TNPSC on

When the matter is taken up for consideration, Mr.Ajmal Khan, learned Additional Advocate General fairly submitted that the impugned panel has been drawn not in accordance with the Rule 27(f) of the Tamil Nadu Revenue Subordinate Service Rules and also not in tune with the decision of the Hon’ble Apex Court in the Case of State of Tamil Nadu and others vs. K.Shobhna and others reported in 2021(4) SCC- 686 and therefore, submitted that the impugned proceedings will be reviewed by the respondents duly taking into consideration the effect of Rule 27(f) as interpreted by the Hon'ble Apex Court in Shobhna's case and also by taking into consideration the effect of Rule 6 of the Tamil Nadu Revenue Subordinate Service Rules at the earliest and therefore, there is no need to adjudicate the matter on merits.
3. The learned Senior counsel appearing for the petitioner has also agreed for the said course of action.
4. In the light of the above, this Court does not see any reason to go into the merits of the matter and accordingly, the writ 4/7 https://www.mhc.tn.gov.in/judis
W.P(MD) No.2314 of 2025 petition is disposed of, duly placing on record the statement made by the learned Additional Advocate General as noted above and directing the 3rd respondent to review the impugned proceedings and draw a panel strictly in accordance with the law laid down by the Hon’ble Apex Court in Sobhana’s case and in terms of Rule 27(f) of Tamil Nadu Revenue Subordinate Service Rules as expeditiously as possible, at any rate within a period of three (3) months from the date of receipt of a copy of this
order and review all the promotions if any, effected pursuant to the impugned proceedings in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
