Hon'ble Vivek Varma,J.
1. Copy of the medical reports of the injured persons namely Satish, Ratan Devi and Neetu, produced by learned AGA, are taken on record. 2. Heard learned counsel for the applicant as well as Sri Neeraj Kumar Sharma, learned AGA for the State, and perused the material placed on record. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the instant case. As per the allegations in the first information report eleven persons including the applicant are alleged to have assaulted the informant and others. Specific role of firing has been assigned to the applicant. In the alleged incident, four persons received injuries. The injuries sustained by them were found simple in nature. No fire arm injury was found on the body of any of the injured. The nature of injuries sustained by all the injured shows that there was no intent to murder. At this stage, there is no credible evidence to link the applicant with the offence. The criminal history of the applicant has been explained in para 13 of the affidavit. It is next submitted that the investigation is pending and the applicant has apprehension of his arrest in the above mentioned case. 5. Learned AGA opposed the prayer for anticipatory bail but could not satisfactorily dispute the aforesaid submissions from the record. 6. Learned counsel for the applicant further submits that the application for grant of anticipatory bail be confined only till the submission of police report. 7.
Having regard to the submissions made by learned counsel for the applicant, considering the nature of accusations and antecedents of the applicant, in particular the fact, that specific role of firing has been assigned to the applicant, in the alleged incident, the injuries sustained by all the injured were found simple in nature, no fire arm injury was found on the body of any of the injured, at this stage, there is no substantive evidence to link the applicant with the offence, without commenting on
merits of the case, I am of the opinion that the applicant is entitled to be enlarged on anticipatory bail till the submission of police report. 8.
